摘 要:恶劣的工作环境不仅损及劳动者的身体健康,还往往成为环境污染的源头。劳动者工作环境权是劳动者保护自己身心健康免受工作环境伤害的权利。我国保护劳动者工作环境权制度基础的特殊性决定了我国保护劳动者工作环境权的主要路径是国家强制保护模式起主导作用。我国刑法应当在保护劳动者工作环境权方面发挥更积极的作用,同时还应适当增强用人单位工会组织的外部性,以增强工会组织对用人单位工作环境的监督功能。Harsh working conditions not only harmthe health of workers,but also often become the source of environmental pollution.Workers have the right to have their own physical and mental health protected fromworking environment,and this right is called the right to working environment.In China,the law does not allow external trade unions to intervene in labor negotiations.The main path which the state uses to protect the right to working environment relies on the mode of national compulsory protection.The criminal law should play a more active role in protecting the right to working environment.The law should strengthen the externalities of trade union organizations of employees appropriately in order to enhance the supervision of trade unions on the working environment of employees.
