摘 要:商标是一种重要的无形资产,通过证券化可以更好地实现商标和品牌的价值。商标资产证券化在微观层面体现出为企业融资的比较优势,在宏观层面体现出国家知识产权强国战略和创新创业政策的科学性,我国有推进商标资产证券化的必要性。有国外商标资产证券化实践可资借鉴,有国家政策支持和企业的先行先试,以及各方主体均可受益的需求形成合力推动,使我国的商标资产证券化具备可行性。法律法规不完善、企业欠缺商标战略和资本运作能力、市场需求有限以及我国社会信用体系不完善制约着我国商标资产证券化的发展。Trademark is important intangible asset.The value of trademark and brand can be better realized through securitization.At the micro level,the competitive advantage of trademark asset securitization is to finance the enterprises.At the macro level,it demonstrates the scientificity of the“Intellectual Property Power House Strategy”and“Mass Entrepreneurship and Innovation”.It is necessary to promote trademark asset securitization in China.With foreign experiences in this regard,the supportive national policy,the pioneering experiments by some enterprises,and the interests of all stakeholders,it is feasible for China to practice trademark asset securitization.There are also restrictive factors for the trademark asset securitization in China,such as the imperfection in laws and regulations,the lack of trademark strategy and capital operation ability by enterprises,insufficient market demand and the imperfect social credit system in China.
