摘　　要：本文系统梳理了提供权的传统国际法背景,现行条约规定,以及在美国、欧盟和中国等国家和地区的具体实施情况,分析了国际、国内理论和实务界对提供权的认识、存在的问题和尚未解决的矛盾,为我国著作权法修订中落实提供权国际法义务,促进网络传播事业的发展提供一个国际视野和有益的借鉴。The paper systematically sorts out the international legal background,current treaty texts,and the implementation of the making available right in US,EU,and China;analyzes the understanding of this right by international and domestic theoretical and practice field,the questions presented,and unresolved conflicts.The paper tries to provide an international vision and insight for China,currently revising its Copyright Law,to implement the international obligation of making available right to improve the development of internet transmission undertakings.
