国家所有权下的无线电频谱资源法律属性研究

摘　　要：无线电频谱是无线电频率排列起来所形成的集合,无线电频谱资源属于非传统自然资源。从物权客体属性角度,无线电频谱资源不属于《物权法》中的动产和不动产,也不属于法律规定的权利,应将其纳入准物权的范畴。国家所有权所指向的对象是国家对无线电频谱资源的初始管理权。无线电频谱资源国家所有权的行使主体是国务院和中央军委,与《物权法》中国有财产由国务院代表国家行使所有权的规定不相符合,需研究制定高位阶的无线电频谱资源法。Property Law stipulates that radio spectrum resources belong to the State,which has drawn the attention of the legal academia.The radio spectrum is a combination of radio frequency.Radio spectrum resources are non-traditional natural resources.From the perspective of object property of the real right,radio spectrum resources do not belong to either the movable property under the Property Law,or to the real estate,and it should be included in quasi-property.The object of state ownership is State′s initial management on the radio spectrum resources.The executive bodies of state ownership of radio spectrum resources are State Council and Central Military Commission.The co-management model of radio management system is inconsistent with Property Law.Higher level law on radio spectrum is needed.
