论电子文献传递服务者的合理注意义务——兼论权利人维权与电子文献传递服务健康发展

摘　　要：电子文献传递服务已超越传统图书馆之间的馆际文献服务,成为主流的文献传递服务方式。电子文献传递服务者应以合法授权为合理注意义务,积极取得著作权人的授权。目前,未经许可的电子文献传递是在互联网技术基础上发展起来的一种新的侵权方式。出版者和权利人应当行动起来制裁侵权行为,积极推动电子文献传递服务健康发展。电子文献传递具有满足用户远程文献需要的意义,应积极规避侵权风险,拓展合法生存空间,呼吁著作权法修法设置电子文献传递的法定许可和著作权补偿金制度,以国家级财政投入建设全国电子文献传递服务中心,增强文献传递服务抵抗风险能力,依法保护权利人的合法权利。Electronic document delivery service has gone beyond the traditional library inter-library document service,which has become the mainstream of document delivery service.Electronic document delivery service providers should take legal authorization as the reasonable attention obligation and actively obtain the authorisation of the copyright owner.At present,electronic document transmission is a new way of infringement which developed on the basis of Internet technology.Publishers and obligee should take action to punish infringement and actively promote the healthy development of electronic document transmission service.Electronic document transmission has the meaning of meeting the needs of remote documents of users,the risk of infringement should be avoided actively,meanwhile We should use and expand the legal survival space and call on the copyright law to amend and set up a system of legal permission and copyright compensation for the transmission of electronic documents.Construction of national electronic document delivery service center with national financial input,so as to enhances the document delivery service ability to resist risks,and to protect the legal rights of the right hold ers.
