摘　　要：目前我国的专利无效制度存在诸多问题,不符合专利法的效率目标。美国、德国和日本代表了三种典型模式,参酌之下,本文对我国专利无效制度改革和完善提出三种可能的选择路径。There are variety of problems under the current patent validity challenge system of China,which is not in conformity with the efficiency target of the patent law.The United States,Germany and Japan represent the three typical modes of patent invalidity system.With reference to the three models,this paper proposes three possible approaches for reforming and improving China’s patent invalid system.
