摘　　要：《反不正当竞争法》的互联网条款规定了四类可责行为,其中前三类是法定行为类型,第四类是对目前尚不适宜法定类型化的不正当竞争行为作出的概括式规定。判别该条款所涉经营行为是否具有正当性,必须立足于现代竞争法的立法理念和价值取向,同时要对现代商业环境尤其是对网络环境充分认知,以谦抑克制的态度包容网络技术与商业模式的推陈出新。反不正当竞争法的规制不再局限于传统的同业竞争情形,而是聚焦于不公平商业行为本身,这种转变有益于应对网络产品竞争形式的多态化发展。判断互联网商业行为正当性应当遵循竞争法上侵权判定的思路,而非侵权责任法上一般侵权行为的判定思路;同时综合考量消费者利益因素、主观过错因素、利益平衡因素、损害后果因素等多元因素。The Internet Terms of the Anti-Unfair Competition Law stipulates four categories of arbitrable behaviors,of which the first three are statutory types of behaviors and the fourth category is a general provision for unfair competition that is not yet suitable for statutory types.To judge whether the business behaviors involved in the clause are justified,we must base ourselves on the legislative concept and value orientation of the modern competition law.We must also fully understand the modern business environment,especially the network environment,and embrace the new network technology and new business model with a modest and restrained attitude.The anti-unfair competition law is no longer confined to the traditional competition in the same industry,but focuses on the unfair business practices themselves.This change is appropriate to deal with the development of diverse network products and business model.Judging the justification of Internet commercial conducts should follow the principle of the competition law,rather than the general principle of the tort law.At the same time,comprehensive factors such as consumer interests,intentional fault,balance of interests,and damage consequences,etc.should be taken into consideration.
