府际大气环境财政权责:配置进路与机制建构

摘　　要：我国以雾霾为首的大气污染问题积重难返,其中最大困顿来自于府际权责纠葛下的环境政策执行偏差。从政府间权责划分的外部关联、内部展开和政治环境来看,大气污染治理与政府职责绑定,市场、社会参与大气环境保护的意愿和权能未能塑造。在财政事权与支出责任划分改革的背景下,为破除这一府际权责纠葛,有必要从政府间大气环境财权、事权与支出责任配置的维度,认识并解构府际大气环境财政权责的基本内涵与主要内容。提出大气环境财政权责配置的可行思路,并建构起大气环境财政权责配置的权责清单机制、动态调整机制和争议处理机制,以迎接新时代的美丽中国建设。The problem of air pollution headed by fog and haze is too hard to overcome,in which the greatest difficulty comes from the deviation of the environmental policy implementation under the entanglement of the intergovernmental power and responsibility.From the perspective of the external correlation and the internal development of the intergovernmental division between power and responsibility and its political environment,the air pollution control is bound up with government duties,but the willingness that the market and the society participate in the protection of air environment and its powers and functions cannot be linked into shape.In the context of the reform of the division between the financial power and the responsibility for expenditure,in order to break such an entanglement of the intergovernmental power and responsibility,it is necessary to understand and deconstruct the basic connotation and the main contents of the intergovernmental power and responsibility of air environment finance from the dimension of the allocation of the intergovernmental financial power,power of affairs,and responsibility for expenditure of air environment.Starting from the approach to the allocation of the union of fiscal decentralization and environmental federal,this article puts forward a feasible thinking of the allocation of the power and responsibility of air environment finance,and constructs the power and responsibility list mechanism,the dynamic adjustment mechanism,and the dispute settlement mechanism,of the allocation of the power and responsibility of air environment finance,in order to meet the Beautiful China Construction in the New Era.
