摘 要:韩进海运有限公司于2016年在韩国申请破产重整程序,成为迄今为止全球最大的航运企业破产案。但是我国法院对该起在全球范围内影响极大的案件并不享有破产程序的管辖权。基于海商法而提起的优先权导致仅部分债权人可以优先受偿,与破产程序着重于所有债权人平等受偿的目的不符。在目前的立法体系下,我国对跨国破产案件管辖权的立法对管辖权的分配不利于国际协调、规定不具有破产特征、运用仍存在着一定空白等缺陷,亟需完善。The case of Hanjin Shipping Co.Ltd.has been the largest bankruptcy case in the world shipping enterprises since it was filed for bankruptcy reorganization in South Korea in 2016.However,China’s law courts never enjoys the right of jurisdiction for bankruptcy proceedings towards this most influential case on a global scale.The priority based on the maritime law led to the priority of partial repayments of only some creditors,which is obviously inconsistent with the insolvency process’s emphasis on the equal compensation of all creditors.Under the current legislative system,China’s jurisdiction over transnational bankruptcy cases is neither conducive to the international coordination of the jurisdiction,nor does it have the characteristics of bankruptcy.There are still some shortcomings in the application of the legislation,which calls for urgent improvements.
