摘　　要：长期以来,研究者对我国住宅合作社发展受阻的外部障碍较为关注,而对作为内部原因的住宅合作社机制缺陷及制度异化问题却较少关注。我国住宅合作社制度的缺陷及异化主要表现为社员身份筛选机制、内部运行机制、设立程序和退出机制、取得划拨用地机制等方面存在实然与应然不一致的矛盾,此为住宅合作社立法的时代局限、经济社会的变迁以及制度更新缺失等因素共同作用的结果。在下一步完善住宅合作社制度的过程中,应适当拓宽成员范围、严格限定资格条件,积极推动住宅合作社回归社会化和自治化的制度初衷,通过提升立法层级、完善立法内容回应和解决影响制约住宅合作社发展的关键问题。For a long time,researchers have paid more attention to the external obstacles hindering the development of China's housing cooperatives,and less attention to internal obstacles such as the defects of the mechanism and the alienation of the system of housing cooperatives.These said defects and alienation are problems mainly for the members'identity and alienation filtering mechanism,the internal operation mechanism,setup procedures and exit mechanism,and the land transfer mechanism.The reasons for this situation are time limitations for housing cooperatives;legislative,economic,and social changes;and lack of system updates.For the next step in improving the housing cooperative system,it is necessary to expand the scope of its members,strictly limit qualification conditions,actively promote the return of the housing cooperative to socialization and autonomy of the system’s original intention,and improve the level and content of laws to respond to and solve the key problems that restrict the development of housing cooperatives.
