摘　　要：体育社会组织法律制度的完善是《体育法》修订的重要内容,加强体育社会组织立法工作,应当首先明确其法人地位。目前,体育社会组织法人地位的法律规定不明晰,理论上也存在较多争议。体育社会组织法人地位的完善措施主要包括:基于《民法总则》明晰我国体育社会组织的法人类型;制定《社会组织法》,构建社会组织的法人制度,为完善体育社会组织的法人地位奠定基础;修订《体育法》,将第五章"体育社会团体"改为"体育社会组织",明确体育社会组织是非营利法人,其中体育社会团体是公益法人或者中间法人;体育基金会和体育民办非企业单位是公益法人、捐助法人。The improvement of the legal system of sports social organizations is an important part of the revision of the Sports Law.To strengthen the legislative work of sports social organizations,we should first clarify its legal person status.At present,the legal provisions on the status of legal persons in sports social organizations are not clear,and there are quite a lot of controversies in theory.The root cause lies in the legal person system in China,especially the imperfection of the legal type of legal persons.The improvement measures mainly include:clarifying the legal person type of sports social organizations in China based on the General Principles of Civil Law;formulating the"Social Organization Law",and constructing the legal person system of social organizations to lay the foundation for perfecting the legal person status of sports social organizations;revising the"Sports Law"and replacing the fifth chapter"Sports Social Association"with"Sports Social Organization",clarifying that the sports social organizations are non-profit legal persons,among which sports social associations are public interest legal persons or intermediary legal persons;sports funds and sports private non-enterprise organizations are public interest legal persons or donation legal persons.
