摘　　要：从全球体育的视角,以法律治理为切入点,从理念、制度和结构三个核心层面分析独具特色的全球体育法律治理机制及我国体育治理改革与发展的回应,以期对我国体育治理法律机制的完善有所裨益。从体育治理的理念层面,我国应培养与推广全球体育"善治"理念、培养规则意识、强化权利意识;从体育治理法律制度的衔接层面,我国应明确全球体育治理法律规则在中国的适用,以及CAS仲裁裁决在中国承认与执行的法律依据,并在体育仲裁和反兴奋剂等具体领域实现与全球体育治理法律制度的衔接;从治理结构的改革层面,我国应积极回应国际体育组织的治理改革,并借鉴其改革的有益经验,优化体育治理的主体结构,发挥体育社会组织的作用,实现体育治理主体的法权平衡,构建基于软法治理内部自治与外部监督相结合的体育社会组织的治理结构。From the perspective of global sports,taking legal governance as the starting point,this present paper analyzes the responses to China's sports governance reform and development under the unique global sports law governance mechanism from the three core levels of concept,system and structure,hoping to promote China's sports legal governance mechanism.The concept is the forerunner of governance behavior,the legal system is the basis and guarantee of governance,and the structural reform is the path and measure of governance.From the perspective of the concept of sports governance,China should cultivate and promote the concept of"good governance"in global sports,cultivate awareness of rules,and strengthen awareness of rights.Secondly,from the interface level of sports governance legal system,China should first solve the application of the global sports governance legal rules in China at the legal level,as well as the legal basis for the recognition and enforcement of CAS arbitral awards in China;cand at the same time,the governance system of corresponding specific areas should be connected with the global sports governance legal system.Among them,the establishment of China's sports arbitration legal system,the connection between China's anti-doping legislation and system implementation are the most prominent problems.Finally,from the perspective of the reform of governance structure,international sports organizations are the dominant players in the global sports law governance mechanism.China should actively respond to the governance reform of international sports organizations,and learn from the useful experience of its reforms,optimize the main structure of sports governance,and give full play to sports social organizations to achieve the balance of legal power of sports governance,thus building a governance structure of sports social organizations through combining internal autonomy and external supervision.
