论聘用制法官助理制度的完善--以职责定位为切入点

摘　　要：各地法院在组建审判团队、落实司法责任制的过程中,都不同程度面临着在编法官助理短缺的问题,招聘聘用制法官助理来缓解是目前较普遍的做法。但在实际运行中,聘用制法官助理"招不来、用不好、留不住"的问题比较突出。究其原因,主要是对于聘用制法官助理的职责定位不够清晰,导致其招录、使用、管理、保障等方面均不同程度与实际需要脱节,影响了法官助理作用的发挥,与预期效果差距较大。本文从聘用制法官助理产生发展过程入手,对其职责定位进行详细解读,以此为基础分析该制度在具体实践中存在的问题及原因,提出针对性完善建议。In the process of forming a judicial team and implementing the judicial responsibility system,all the courts around the country are faced with the problem with shortage of judge assistants.It is a common practice to recruit contract judge assistant.However,in the actual practice,there exists the problem with the contract judge assistants who is“hard to employ,inefficient to work and unwilling to retain.”The main reason is that the duties of judge assistant is not clear enough,which leads to the fact that the recruitment,use,management,social security and other aspects of the judge assistant are not in line with the actual needs to some degree.Thus the role of judge assistants is affected and the expected effects can’t be reached.From the perspective of the emergence and development of the contract judge assistant system,the paper is intended to make a detailed interpretation of the duty,analyze the problems and the reasons for the system in the actual practice and put forward specific suggestions for improvement.
