摘　　要：不断完善的土地征收法为改革开放的顺利推进提供了必要条件。改革开放以来,土地征收法的主要发展变化有:从单行法转变为了诸法合体,"土地征收"概念取代了"土地征用"概念,土地征收审批权不断地被上收,补偿标准不断地被提高,省级人民政府的土地征收决定的可诉性得到了明确。展望未来,土地征收法的完善方向是:制定统一的土地征收法、明确规定征收土地的公共利益范围,科学设置土地征收审批机关,按照被征收土地的市场价值给予被征收人公正补偿,有效保障被征收人的救济权。The continuously optimized land expropriation law provides is the precondition for promoting the smooth progress of reform and opening up.Since the beginning of the reform and opening up,the main developments and changes of the land expropriation law include:special regulations has been changed to be the combination of various laws,the concept of“land acquisition”has been replaced by the concept of“land expropriation”,the land expropriation examination and approval authority has been continuously controlled by higher levels,the compensation standard has been continuously raised,and the justiciability of the land expropriation decision of the provincial people's government has been clarified.Looking forward to the future,the direction for the optimization of the land expropriation law is to formulate a unified land expropriation law,clearly define the scope of public interest for land expropriation,scientifically set up the land expropriation examination authority,and give fair compensation to the expropriated persons according to the market value of the acquired land,thus effectively guaranteeing the relief right of the person being expropriated.
