摘　　要：刑法解释僭越刑事立法的现象实践中时有发生。刑法解释僭越刑事立法不同的类型和表现形式,呈现出不同的社会危害表征。这些社会危害包括模糊了刑法解释与刑事立法的界限,不利于维护刑法的权威性;造成了社会保护机能与人权保障机能的失衡,不利于社会机能的实现;导致了立法解释权、司法解释权以及立法权之间矛盾重重,并极大削弱了刑法立法权。对此,应从树立正确的刑法解释观念、尽可能保障刑法立法的适时性、构建刑法解释僭越立法的撤销和避免机制等方面着手来加以规避。The interpretation of criminal law overstepping criminal legislation has occurred in practice now and then.The different types and manifestations of criminal law interpretation overstepping legislation show different representations of social harm.These social hazards are as follows:blurring the boundary between criminal law interpretation and criminal legislation,which is not conducive to the maintenance of the authority of the criminal law,resulting in the imbalance between the function of the social protection and the function of human rights protection,which is not conducive to the realization of the social function.It has led to the contradiction among the legislative interpretation power,the judicial interpretation power and the legislative power,and greatly weakened the legislative power of criminal law.In this regard,we should set up a correct concept of interpretation of the criminal law,ensure the timeliness of criminal legislation as far as possible,and construct the mechanism of the revocation and avoidance of the criminal law interpretation overstepping legislation,and finally achieve evasion of the criminal law interpretation overstepping criminal legislation.
