摘 要:深圳土地整备是由政府主导的土地再开发的重要模式之一,其目的是实施规划并解决原农村土地的历史遗留问题。本文通过回顾我国农村工业化发展过程并分析深圳原农村集体土地非农化的特点,说明深圳原农村土地问题的根源在于农民与国家在工业化和城市化利益分配上的矛盾,指出解决这些问题应该遵循利益共享、责任共担的原则。深圳土地整备制度的内在逻辑就是利益共享机制的设计,使土地整备后的土地增值收益和整备成本在政府、社区、村民三者之间进行公平合理地分配和分担,并在过程中充分发挥原农村集体社区组织的作用。Land rearrangement in Shenzhen is one of the important modes of government-led land redevelopment.Its purpose is to implement planning and solve the issues of originally rural land left by the history.After reviewing the development process of rural industrialization in China and analyzing the non-agricultural characteristics of originally rural collective land in Shenzhen,this paper expounds that the problems of originally rural land in Shenzhen are caused by the contradiction between profit distribution of peasants and government in the industrialization and urbanization.It points out that the principle of sharing interests and responsibilities should be followed to solve these problems.The inherent logic of land rearrangement system in Shenzhen is the design of benefit sharing mechanism.The land addvalue benefit and cost after its rearrangement should be fairly and properly distributed and shared among the governments,communities and villagers.In the process,the organization of original rural community should play its role fully.
