英国不成文宪法的反思与重构——评波格丹诺著《新英国宪法》

摘　　要：英国不成文宪法的历史传统能否延续,激发了波格丹诺的深切思考。有鉴于经典宪法著述对现实解释力渐衰,而新成文宪法的理论构造尚未完成,英国的宪制转型处于一个关键的过渡时期。《新英国宪法》秉承了英国学界一贯的忧患意识,对英国民主宪制的转向进行了系统性的反思。这种立基于英国实践的学理探究,有助于激发英国民主政治的活力,也为宪法理论与实践提供了有益借鉴。Whether the historical tradition of English unwritten constitution will continue inspires Bogdano’s deep thought.Because the interpretations of many classics of previous scholars decrease,while the framework of new written constitution still does not establish,it is in a transitional era.With the inheritance of coherent sense of crisis,The new English constitution provides us with a new approach of constitutional transformation with systematic reflections.This theoretical exploration of English constitutional practices,not only contributes to activate the vitality of British democratic politics,but also provides helpful references in theory and practice.
