关于修改纪检机关监督执纪工作规则的若干思考

摘　　要：为全面贯彻落实党的十九大精神,适应国家监察体制改革后纪法贯通的需要,建议对《中国共产党纪律检查机关监督执纪工作规则(试行)》进行修改,充实执纪监督有关内容,增加监督执纪执行程序,对篇章结构进行适当调整,分为总则、执纪监督、执纪审查、执行、监督管理、附则六编。在总则中确立习近平新时代中国特色社会主义思想在监督执纪工作中的指导地位,完善纪检机关内设监督机构工作机制,明确派驻机构监督执纪权限。在执纪审查编中规定初步核实条件和时限,完善审查时间计算规定,细化审查措施适用条款,完善案件审理工作流程。在监督管理编中,扩大回避制度、保密制度适用范围,完善干预监督执纪报告登记制度。In order to implement the spirit of the 19th National Congress of the CPC,and meet the needs of the link-up of the Party′s Discipline and the Country′s Law after the reform of the state supervision system,it is suggested to revise the Rules of Supervision and Discipline Enforcement of the Discipline Inspection Organs of CPC(for Trial Implementation),enrich the relevant contents of supervision and discipline enforcement,increase the procedures of supervision and discipline enforcement,make appropriate adjustment to the text structure.The rules can be divided into six parts,including general provisions,supervision and discipline enforcement,discipline enforcement and examination,supervision management,and supplementary provisions.In the part of general principles,the guiding position of Xi Jinping′s socialist thought with Chinese characteristics in the supervision and discipline enforcement work will be established;the working mechanism of the internal supervision organs in the discipline inspection organs will be improved;and the authority of the agencies stationed to supervise and discipline practice will be clarified.In the part of discipline enforcement and examination,the preliminary verification conditions and time limits will be stipulated;the calculation of examination time will be improved;the applicable provisions of examination measures will be refined;and the work flow of case trial will be improved.In the part of supervision management,the scope of application of the challenge system and the confidentiality system will be expanded,and the report and registration system of the interferences in supervision and discipline enforcement work will be improved.
