摘　　要：运用文献资料法等分析体育产业立法,讨论当下体育产业发展的立法现状与改进路径。主要结论:当前体育产业法律存在空白,体育产业发展相关的法律法规效力层级较低,且立法理念和制度设计亦有缺陷。建议:《体育法》修改写入体育产业章节,建构适应体育产业发展的法律体系应完善以产权保护机制为轴心的私法激励制度,建立以现代企业为支点的产业组织制度,建立以财税金融机制为主体的公法辅助制度,在横向与纵向两个维度完善体育产业法律体系。By using method of literature reviews,this paper analyzes the legislation of sports industry,and discusses current situation of legislation and ways to improve it.Main conclusions are as followed:There are some problems exist in the current sports industry,and the laws and regulations related to the sports industry are running in low effectiveness,and the legislative concept and system design are defective.Suggestions can be listed as followed:the sports industry chapter should be written into the sports law.To construct a legal system suitable for the development of sports industry,department should perfect the private law incentive system with the property right protection system as a core,establish industrial organization system with the modern enterprise as a assistance,to build up the public law auxiliary system with the financial mechanism as the main body,and perfect the legal system of sports industry from both horizontal and vertical dimensions.
