我国体育法中犯罪条款的问题反思与修改完善

摘　　要：随着体育事业的繁荣发展,体育法治建设已成为我国全面推进依法治国的重要内容。在依法治体的过程中,体育法的修改成为社会关注的热点之一。然而,体育法中的犯罪条款如何修改,却并未得到足够重视与充分讨论。在我国体育法中,犯罪条款分为体育附属刑法与体育刑事指引性规定2种类型,在规制、预防体育领域的犯罪方面有积极作用,是全面依法治体的重要一环。但是,现阶段我国体育附属刑法与体育刑事指引性规定仍然存在一些问题,体育附属刑法的内容未臻完善、范围仍有盲区,体育刑事指引性规定存在越权立法、部分内容存在缺陷的问题,这些问题制约着体育附属刑法及其刑事指引规定的立法效果。问题的解决不仅有赖于我国立法进步的整体推动,还要在具体研究探讨的基础上逐步修改完善体育附属刑法和体育刑事指引性规定的缺陷。对体育附属刑法存在的问题,需要完善缺陷、清扫立法盲区、使用司法解释增加明确性;对于体育刑事指引性规定而言,需要纠正超越立法权限、修正超出刑法规制范围等问题,同时增强内容的明确性、精确性及其犯罪的定量因素。最终,实现二者与刑法的顺畅衔接,共同辅助刑法肃清阻挡体育事业发展的犯罪荆棘。With the prosperous development of sports cause,the construction of ruling sports by law has become an important content of promoting the rule of law in China.In the process of ruling sports by law,the revision of sports law has become one of the hot spots of social concern.But,the revision of the criminal clauses in the sports law has not received enough attention and full discussion.In China's sports law,the criminal clauses fall into two types that subsidiary criminal law and criminal guiding regulations of sports.They play an active role of regulating and preventing crimes in the field of sports and become an important part of ruling sports by law.However,there are still some problems in subsidiary criminal law and criminal guiding regulations of sports at this stage.The subsidiary criminal law of sports has not been completed and exist blind zone in scope of legislation.The criminal guiding regulations of sports have problems that the over-authority legislation and some defects in contents.These problems restrict the legislative effect of the subsidiary criminal law and criminal guiding regulations of sports.The solution of the problem not only depends on the overall promotion of China's legislative progress,but also gradually revises and completes subsidiary criminal law and criminal guiding regulations of sports on the basis of specific research and discussion.For the problems existing in subsidiary criminal law of sports,it is necessary to perfect the defects,clean up the legislative blind area and use judicial interpretation to increase the clarity.For the criminal guiding regulations of sports,it is necessary to correct the problems which are beyond the legislative authority and beyond the scope of criminal law regulation,at the same time,to enhance the clarity,accuracy of contents and quantitative factors of crime.Finally,establishing the connection between both sides and the criminal law so that to assist the criminal law to eliminate the obstacles of development in sports cause.
