摘　　要：修改《铁路法》是铁路行业的一件大事。修改《铁路法》,既要充分反映铁路行业的特点,把铁路发展对法律的需求及时、完整、准确地表达出来,也要体现国家对铁路发展的政策,如公益性运输补贴、运价政策、铁路建设用地综合开发、税收减免、铁路发展基金等基本问题争取通过法律作出明确规范。提出《铁路法》修正案框架体系主要由总则、铁路规划与建设、铁路运输管理、铁路运输营业、铁路安全与保护、监督管理、法律责任和附则八个部分组成,明确亟需规定的内容,为修改《铁路法》提供立法建议。The amendment of the Railway Law is a big event in the railway industry.To amend the Railway Law,it is needed that not only fully fits the characteristics of the railway industry,but also expresses the requirements of the railway development in an accurate way,as well as the national policy such as the subsidy for the public transport,the comprehensive development of the railway construction land,the tax relief,the railway development fund and so on.Basic issues should be clearly regulated by law.The author proposes that the frame system of the amendment to the Railway Law in eight parts,clarifies the required contents,and provides legislative proposals.
