摘　　要：随着大数据时代的到来,互联网上个人数据的使用量在规模上是前所未有的。计算机的记忆不同于人的记忆,人可以选择忘记,但机器不会。个人信息一但被发布到网上,就成为永远抹不去的记录,一些过时的信息对人日后的工作生活影响巨大,因此,个人对全球网络信息系统中与其有关的信息的自我控制和正确性、时效性等因素的及时纠正机制问题成为迫切需要解决的问题,这就使"被遗忘权"有了确立的必要。然而,我国现行立法中还没有明确这项权利规定,因此,有必要借鉴别国已有经验和教训,以期少走弯路。文章试图对俄罗斯被遗忘权的界定、内涵以及司法实践等立法现状进行分析,从而总结出对我国有益的启示。With the coming of the era of big data,the amount of personal data used on the Internet is unprecedented in scale.Computer memory is different from human memory.People can choose to forget,but machines can not.Once personal information is posted on the Internet,it becomes a record that can never be erased.Some outdated information has a great impact on people’s work and life in the future.Therefore,it is an urgent problem to solve the problem of self-control,correct and timeliness of the information in the global network information system,which makes the“right to be forgotten”necessary.However,our current legislation has not clearly defined this right,so it is necessary to learn from the experience and lessons of other countries,in order to have few detours.Through combing the status of the legislation of the right to be forgotten in Russia,this paper summarizes the beneficial enlightenment to us,and puts forward the legislative construction of the right to be forgotten in accordance with the national conditions of our country.It is helpful to guide our country to choose the appropriate legislative mode,so as to grasp the scientificity and integrity of the legislation.
