摘 要:中央环保督察是一项督促地方党委政府履行环境保护主体责任,全面提升生态文明建设水平的重大制度实践。然而,中央环保督察在首轮督察以及"回头看"中所暴露出来的法治困境,却在一定程度上削弱了督察结果的实效性与制度运作的持续性。因此,应当在肯定中央环保督察实施意义的基础上,针对其存在的法治困境,从完善法律依据、规范督察问责、健全公众参与机制等方面将中央环保督察纳入法治化的轨道,实现"运动型环境督察"向"常态型环境督察"的转变。The central environmental supervision is a major institutional practice that urges local party committees and governments to fulfill their main responsibilities for environmental protection and comprehensively improve the level of ecological civilization construction.However,the difficult situation of the rule of law faced by the central environmental supervision has affected the effectiveness of the inspection results and the continuity of the system operation.Therefore,the central environmental supervision should be put into a law-based track in terms of improving the legal basis,regulating supervision and accountability,and improving the public participation mechanism so as to achieve the transformation from“motorial environmental supervision”to“regular environmental supervision”
