摘 要:公众参与是政府行政决策之所需,实践中在决策民主和决策监督等方面虽已取得了良好的效果,但也应该认识到公众在其参与范围、参与能力和参与地位的有限性、决策民主化与决策科学化之间以及民意真实性与决策合理性之间存在的矛盾。通过客观审视和理性对待公众参与环境行政决策,提出有必要坚持国家环境行政权的主导地位、尊重我国现阶段公众参与能力现状、破解专家论证"污名化"与化解内部决策"失信化"的多种决策方式协同发展的公众参与环境行政决策建议,以期为进一步的制度改进提供理论依据。Executive decision requires public participation which has achieved good effects in practice,such as in terms of democracy and supervision of decision-making.Yet we should recognize the limits of the range,capability and status of public participation as well as the contradiction between democratic and scientific decision-making,between real public opinion and decision rationality.By objectivly comment on public participation in environmental administrative decision-making,this paper thinks that it's necessary for our country to insist on the dominant status of environmental administrative decision-making at national level,respect the status quo of public participation,remove the"stigmatization"of peer review and"discredit"of internal decision,trying to form synchronized development of multiple decision-making modes and provide theoretical foundation for further institution improvement.
