摘 要:2013年12月,劳动教养制度被废止。劳教制度因缺乏合宪性合法性依据、程序不正当、实际运行过程中的权力滥用和制度扭曲等问题,早在上世纪90年代就有学者质疑并提出废除的建议,直至十数年后,劳教制度才被正式废止。在"后劳动教养时代",对劳教制度进行历史的回溯和考察,分析其劳教制度存废的原因,对劳教制度的内在凸显的价值失衡和权力失衡展开法治反思,并在此基础上重构危害社会行为制裁体系,建立起我国的轻罪制度,从而推动建设法治社会。In December 2013,the system of reeducation through labor was abolished.Because of the lack of constitutionality and legality basis,improper procedure,the abuse of power and system distortion in the process of actual operation,the system of reeducation through labor has been questioned and proposed to be abolished by scholars in the 90s of last century.It was not until about ten years later that the reeducation through labor system was formally abolished.In the“post labor reeducation era”,the system of reeducation through labor is traced back and inspected historically.Also the existed and abolished reasons of the reeducation through labor system are analyzed.The imbalance of value inherent and power in the system of reeducation through laborare reconsidered by the rule of law.Based on this,sanctions system for endangering society behavior should be reconstructed and misdemeanor system in China should be established to promote the construction of a society under the rule of law.
