摘 要:我国建国后的农地政策经历了从家庭所有、家庭经营,家庭所有、集体经营,集体所有、集体经营,集体所有、家庭经营,到集体所有、多种主体经营的变化历程。该政策建立的理论基础是中国特色社会主义公有制理论。以经济学的权利束理论、法国民法理论中的所有权分解理论都难以对当前的农地三权分置提供论证工具,只有权利派生理论才能证成土地所有权承包权经营权分置的政策内涵。鉴于放活土地经营权是农地三权分置政策的主要目标,在修改土地承包法过程中应该注重土地经营权法律属性的明晰和科学设计土地经营权权能落实的具体措施。Since the founding of People’s Republic of China in 1949 the policy of Chinese agricultural land has undergone family ownership,family operation collective operation,collective ownership,family operation,collective ownership and pluralistic operation in different times.It should be noted that our policy is based on the socialist public ownership system with Chinese characteristics.The power-binding theory of economics and the ownership division theory of French civil law theory cannot account for the on-going tripartite power division of agricultural land;only the power derivation theory can attest to the policy related to the power division regarding the land ownership,contract and operation.Given that flexible use of land operation is the main goal of the tripartite power division policy of agricultural land,we should clarify the legal properties of land operation power and scientifically design concrete measures in relation to the land operation power implementation while modifying the land contract law.
