摘　　要："一带一路"倡议下我国对外投资活动发展迅速,对外投资规模逐步扩大,与之相应的投资保险法律制度建设却进展缓慢,难以适应现实需求。我国应审视对外投资法律体系的科学性、完整性,从完善国内立法、与国际立法接轨两个层面,建立以双边模式为主、单边模式为辅的混合型投资保险制度,构建投资者与担保机构之间的争端解决机制,合理拓展对外投资主体的范围及保险机构的承保范围,为我国企业对外投资提供规范依据和保障。Under the"the Belt and Road"Initiative,China′s foreign investment activities have developed rapidly,and the scale of foreign investment has gradually expanded.However,the corresponding investment insurance legal system construction has made slow progress and it is difficult to meet to actual needs.China should examine the scientificity and integrity of the foreign investment legal system.From improving domestic legislation and integrating with international legislation,we should build a hybrid investment insur?ance system based on bilateral models and supplemented by unilateral models,establish the dispute settlement mechanism between in?vestors and guarantee agencies,rationally expand the scope of foreign investment entities and the coverage of insurance agency,provide a standardized basis and guarantee for Chinese enterprises′foreign investment.
