海上溢油生态损害经济补偿的决定因素研究

摘　　要：影响海上溢油生态损害经济补偿的因素很多,如责任限额、事故位置、溢油量、油品、受害国人均GDP等。实践中,IOPC Funds已经处理了82起中大型海上溢油污染损害的经济补偿问题。运用灰色关联度分析方法对这82起经济补偿案例进行分析,可以发现:(1)不同因素对海上溢油生态损害经济补偿的影响程度有强弱之分,6要素的关联度系数分析结果为责任限额>事故位置>溢油量>受污染海岸线长度>油品>受害国人均GDP,4要素的关联度系数分析结果为责任限额>溢油量>油品>受害国人均GDP。(2)责任限额和溢油量是影响补偿额的两个决定因素,而责任限额对补偿额的影响又大于溢油量。Many factors influence compensation for ecological damage of marine oil spill,such as limitation,accident location,oil spill volume,density,GDP per capita,etc.In practice,IOPC Funds has disposed compensation of 82 large and medium marine oil spill accidents.By analyzing these 82 compensation cases with grey relational analysis,we can come to the following conclusions:(1)Different factors have different influences on compensation for ecological damage of marine oil spill.Correlation coefficient of 6 factors is:limitation>accident location>oil spill volume>contaminated coastline length>density>GDP per capita,and correlation coefficient of 4 factors is:limitation>oil spill volume>density>GDP per capita.(2)Limitation and oil spill volume are the two determinants,but limitation is more important than oil spill volume.
