摘 要:民主立法是全面实施依法治国战略的重要内容。我国公众参与立法既有较为全面的政策依据,也有比较系统的法律法规,基本上实现了有法可依。从依法立法的角度看,我国公众参与立法依然存在法律法规规定模糊、公众参与范围狭窄、参与方式有限、参与热情不高等不足。解决上述问题需要从以下几个方面着手:建立利益激励机制,提高公众参与意愿;明确立法机关职责,防范其恣意行事;加强配套制度建设,搭建公众有效参与平台;完善意见反馈机制,促使公众积极参与;培育组织化利益团体,提高公众参与能力和参与成效;发挥立法智库作用,完善第三方独立参与制度。Democratic legislation is an important part of implementing the strategy of administering the country according to law in an all-round way.China has a comprehensive policy basis for public participation in legislation,and there are relatively systematic laws and regulations.From the angle of law legislation,the public participation in legislation in China still exists the lack of legal provisions,the narrow public participation,the limited participation mode and the low participation enthusiasm.To solve the above problems,we should start from the following aspects:to establish an incentive mechanism to improve public participation consciousness,to clarify the responsibilities of the legislature,to prevent its unscrupulousness,to strengthen the construction of the supporting system,to build an effective participation platform for citizens,to improve the feedback mechanism of opinions,to promote the participation of the public,to foster the organization of interest and to improve the public’s ability and effectiveness of participation,playing the role of the legislative think tank and improving the third party’s independent participation system.
