摘  要:中国船舶油污损害赔偿基金制度于2012年7月1日建立,为海洋环境保护和海洋运输业持续健康发展发挥了积极作用。海事主管机关、海事法院、航运保险公估公司、船舶污染清除单位等相关机构和单位对基金的理赔标准尤为关注,文中通过比较研究国内外船舶污染清除费率标准,重点对基金理赔标准展开分析,以期对船舶油污损害赔偿各利益方的纠纷解决提供指导和帮助。Since its establishment on July 1,2012,China Ship-source Oil Pollution Damage Compensation Fund(COPC Fund)has played an active role in the protection of marine environment and the sustained development of maritime transportation industry.Such organizations as the maritime administration,maritime courts,shipping insurance companies,ship pollution clear-up agencies all pay close attention to the standards of compensation by the fund.Based on the comparison between the China and other countries on the standard of the rate for ship pollution clear-up,the paper focuses on the analysis of the standards of compensation by the fund,aiming at providing guidance and assistance to the settlement of disputes between related stakeholders.
