摘　　要：园艺作物普遍具有较高的经济效益,保供增收作用明显。育种是园艺作物长期持续发展和品种更新的保障,品种权保护是育种者获得利益的保障和持续开展育种工作的动力。因此,了解园艺作物品种保护的发展现状以及存在的问题对于推动其发展具有重要的意义。从主要园艺作物品种保护种属范围、品种保护权申请情况、品种申报主体组成、品种保护权申报区域构成等方面对我国园艺作物品种保护现状以及存在的问题进行分析,并从品种宣传、法律保障、政策支持、企业引导4个方面提出了我国主要园艺作物品种保护的发展对策。Horticultural crop has high economic benefits and has remarkable effects on supply guarantee and increase farmers’income.Breeding could provide basis for long-term sustainable development and variety renovation of horticultural crop.Protection of plant variety right of could guarantee benefits of and give impetus continuously for breeders.Therefore,it is of great importance to enhance development of horticultural crop by research on development status and existing problems of horticultural crop variety protection.In this paper,the range of species and genus of main protected horticultural crop,application situation of protection right of new varieties,application subject constitution,and declare region structure of protection right of new variety were analyzed and some development countermeasures were also proposed from four aspects including variety publicity,legal protection,policy support and entrepreneur guidance.
