摘　　要：网络著作权侵权行为具有规模大、速度快、隐蔽性强的特点,更需要发挥行政法保护的比较优势以及公私利益平衡优势,加强保护与监管。当下法律规范体系缺少统一的多层次的专门规定,法出多门,操作性差,立法滞后,存在多头执法的弊端,应在坚持职权法定、法律优位、法律保留三项原则的前提下,完善网络著作权行政保护的法律体系、合理使用制度以及行政救济,以更好地保障著作权人的合法权利,促进信息的传播与网络秩序的良性发展。Network copyright infringement has the characteristics of large scale,fast speed,and strong concealment.It is necessary,therefore,to strengthen the copyright protection and supervision using the comparative advantage of the administrative law’s protection and the balanced advantage of the public and private interests.Currently,the legal system’s lack of unified multi-level special provisions,law coordination among different departments,efficient operability,and timely legislation result in duplicate law enforcement.On the premise of the three principles of statutory authority,law’s superior position,and law reservation,the legal system for the administrative protection of network copyright must be perfected.The proper use the system and administrative remedial measures will better protect the legitimate rights of copyright owners and promote the dissemination of information and the healthy development of the network order.
