摘 要:"寓教于审"贯穿于庭审的全过程,庭审教育作为未成年人刑事庭审程序的重要一环,与圆桌审判具有共同的人文关怀,两者蕴含着"寓教于审,教罚结合"的理念,承接着国家监护与未成年人福利的理念,承载着未成年人利益最大化理念。而通过问卷调查、访谈座谈及影响性诉讼案件的实证考察,可窥见,圆桌审判的适用范围过窄,呈现出形式化与虚无化,欠缺专门法庭等基础性设施;庭审教育则重形式而轻实质,沦为"一句话教育"。针对践行困境,应当建构以圆桌审判为中心的多元庭审模式,创设层级化与多样化的未成年人审判机构,注重庭审教育的"量"与"质",以实现未成年人优先保护与特殊教育之程序初衷。“Teaching in trial”runs through the whole process of trial.As an important part of criminal trial procedure of juveniles,trial education has a common humane concern with the sentencing circle.Both of them contain the concept of“teaching in trial and the integration of punishment with teaching”,undertake the concept of state guardianship for the benefits of minors and carry the concept of maximizing the interests of minors.However,it is revealed in the questionnaire survey,interviews and empirical investigation of influential litigation cases that the application scope of the sentencing circle is too narrow,showing the tendency of formalization and nihility and the lack of the basic facilities of specialized courts.Also,the court trial education,which emphasizes on the form instead of the essence,leading to“a word education.”In order to solve the dilemma,we should construct a multiple court trial model which is centered on the sentencing circle in hopes to establish a hierarchi cal and diversified trial court for minors and attach great attention to the“quantity”and“quality”of trial education to realize the priority protection and the original intention of special education program.
