摘　　要：中国农村集体产权制度改革中妇女权益受侵害状况较为普遍,这不符合"男女平等"的现代法律理念,也阻碍了经济社会的可持续发展。本文基于女性主义经济学的视角,借鉴其旨在提高妇女地位、改善妇女经济状况的基本观点,根据"中国裁判文书网"上公开的农村集体经济组织成员资格相关纠纷案件、地方立法文件,使用定性研究方法、案例分析方法、比较分析方法考察了农村集体产权制度改革中的妇女权益保障问题。本文提出,法律制度的漏洞、村民自治的有限性、经济利益关系失衡是保障农村妇女权益的主要制约因素。在全面深化农村集体产权制度改革中,应完善农村妇女权益保障相关法律制度、村民自治制度,明确新时代农村妇女权益保障的新目标是"既追求性别平等,又追求经济增长,实现两者的综合发展"。Women’s rights and interests are generally damaged during the collective property rights system reform in rural China.It is inconsistent with modern legal concepts of equality between men and women,and has been an obstacle to the sustainable economic and social development.This article conducts an analysis from the perspective of feminist economics,aiming at improving women’s economic condition and social status.Based on cases of disputes over membership of rural collective economic organizations on the Chinese Judicial Document Network and local legislative documents,the study uses qualitative research method and investigates the protection of women’s rights and interests in the collective property rights system reform in rural areas.The study points out that the flaws in the legal system,limitations on villagers’self-governance and an imbalance of economic interest relationship are the main factors that hinder the protection of rural women’s rights and interests.In the process of comprehensively deepening the collective property rights system reform in rural areas,China should improve the legal system and villagers’self-governance system to protect rural women’s rights and interests.Meanwhile,a new objective of protecting rural women’s rights and interests in the new era should be defined as comprehensive development of gender equality and economic growth.
