云计算SaaS模式下的著作权侵权分析

摘　　要：在云计算SaaS模式下,云服务提供商将软件上传到"云端"并提供给云用户使用但并未提供计算机软件的永久复制件,故此行为不受出租权的规制;在线运行、使用软件属于信息网络传播权定义下的获得作品,云服务提供商向云用户提供软件使用许可的行为受到信息网络传播权的规制。依据《最高人民法院关于审理著作权民事纠纷案件适用法律若干问题的解释》第21条规定的字面含义,云用户未经许可商业性地在线使用、运行盗版软件时在计算机内存中形成软件的临时复制就直接侵害了软件著作权人的复制权;在此情形下,如果云服务提供商与云用户有共同侵权的意思联络,则云服务提供商与云用户均是软件复制权的直接侵权人;如不存在共同侵权的意思联络,但云服务提供商明知直接侵权会发生,依然将未经许可的或盗版的软件提供给云用户在线运行使用,则云服务提供商因此构成对复制权的间接侵权。In the SaaS model of cloud computing,the cloud service provider uploads the software to the“cloud”for customers to use but doesn’t offer the permanent copy of the computer software.Therefore,the behavior is not regulated by the rental right.The online operation and use of the software can be understood as“obtain works”under the definition of“information network transmission right”,and the behavior that the cloud service licenses the software to users is thus regulated by the“information network transmission right”.According to the literal meaning of article 21 of the“Interpretation of the Supreme People’s Court concerning the Application of Laws in the Trial of Civil Disputes over Copyright”,cloud users directly infringe the software copyright owner’s reproduction right when they commercially use and operate the pirated software online without permission and generate temporary copy of the software in computer memory.Under the circumstance,if cloud service providers and cloud users have intentional liaison in the infringement,they are both direct infringers of the reproduction right.Without the intentional liaison,the cloud service provider constitutes indirect infringement of reproduction right if he knows that the direct infringement will occur and still provides the unlicensed or pirated software for cloud users to operate and use online.
