“硬法之维”到“软硬混治”:民族传统医药保护的话语转向及其理路重构

摘　　要：在法律人类学视域中,民族传统医药不但是一项医学技艺,更是一种凝聚民族文化、彰显民族价值的地方性知识。然而,随着"国家在场"的推进,现代医药技术开始渗入至民族地区,使得民族传统医药知识被逐步边缘化,进而处于"失语"状态。由于民族传统医药与知识产权制度和非物质文化遗产制度之间的固有嫌隙,使得"硬法"难以完全介入民族传统医药保护体系。这就亟需引入"软法"机制,从而实现民族传统医药保护的话语转向,即建构一条以"硬法"为主体、"软法"为补充的复合型保护路径。From the perspective of legal anthropology,ethnic traditional medicine is not only a medical skill,but also a local knowledge that condenses national culture and highlights national values.However,with the promotion of the national law,modern medicine technology began to infiltrate into the ethnic areas,making the traditional knowledge of medicine gradually marginalized,and then in the"Aphasia"state.Due to the inherent rift between traditional medicine and intellectual property rights system and the institution of intangible cultural heritage,it is difficult for the national law to fully involve in the national traditional medicine protection system.Therefore,it is urgent to introduce the"soft law"mechanism,so as to realize the discourse turn of the protection of traditional ethnic medicine,which is to build a compound protection way supplemented by law and"soft law".
