摘 要:近年来,按照中共中央、国务院关于生态文明建设等的有关要求,矿产资源有偿使用制度将探矿权价款、采矿权价款调整为矿业权出让收益,这一改革是维护国家所有者权益的有效举措,是深化和完善矿产资源有偿使用制度的重要进展。本文系统梳理了我国矿业权从无偿授予到全面有偿5个阶段的历史沿革和转变过程,分析了探矿权价款、采矿权价款制度存在的突出问题和矿业权出让收益制度的改革特点,重点就出让收益制度与价款制度之间的衔接问题进行了讨论,并就进一步完善矿业权出让收益制度、做好新旧制度的衔接,以及矿业权审批登记管理工作提出有关政策建议。In recent years,in accordance with the relevant requirements of the Party Central Committee and the State Council on the construction of ecological civilization,the system of paid use of mineral resources adjustsmining rights price to the mining rights transfer proceeds.This reform is an effective measure to safeguard the rights and interests of the state s owners and an inevitable requirement for improving the system of paid use of mineral resources.The article systematically sorts out the historical evolution of the five stages of China s mining rights paid acquisition system,and analyzes the problems existing in the mining rights price and the reform highlights of the mining rights transfer proceeds system.At the same time,it points out the institutional connection problem between the mining rights transfer proceeds and mining rights price in management practice,and puts forward the policy recommendations to further improve the mining rights transfer proceeds system and the mining rights approval registration management.
