摘 要:提高我国行政执法体制的系统性、整体性、协同性,对推进政府治理体系与能力现代化具有重要的意义。实践中,行政执法出现了不同类型的跨部门协同问题,由此产生分散化、碎片化等治理现象。这些问题的产生,既有行政执法体制层面的组织结构性因素,也有行政立法层面的部门立法因素,还有行政主体层面的因素。要进一步消除行政执法中跨部门协同问题,应推进行政执法体制综合化改革、优化跨部门协同机制、强化跨部门信息共享与平台建设、提升个体的协同价值理念和能力、积极吸纳社会参与。Improving the systematicness,integrity and synergy of China’s administrative law enforcement system is of great significance to promoting the modernization of government governance system and capacity.In practice,there are different types of cross-sectoral coordination problems in administrative law enforcement,resulting in decentralization,fragmentation and other governance phenomena.The emergence of these problems includes not only the organizational structural factors at the level of administrative law enforcement system,but also the departmental legislative factors at the level of administrative legislation,as well as the factors at the level of administrative subjects.In order to further eliminate the problems of cross-sectoral coordination in administrative law enforcement,we should promote the comprehensive reform of administrative law enforcement system,optimize cross-sectoral coordination mechanism,strengthen cross-sectoral information sharing and platform construction,enhance individual value concept and ability of coordination,and actively absorb social participation.
