摘 要:权力在本质上是占有和控制公共资源的能力。权力任性就是将手中的资源作为腐败的资本,搞权力寻租等,与腐败具有同质性。要避免权力任性,一方面要立足客观源头,用法治来锁定公共资源的边界,从资源的评估与法治结合上来制定权力的边界,使权力清单制与法治配套;另一方面要立足主观源头,不仅对权力的主体进行信仰教育、党性教育、法治教育等,而且对权力的主体进行系统、有效的监督。只有从主客观两个源头上治理权力任性,才能从根本上扼守避免权力任性的阵地。Power is essentially the ability to possess and control public resources.The power willfulness is to use the resources in the hands as corrupt capital,to engage in power rent-seeking,etc.,and to have homogeneity with corruption.On the one hand,to avoid the power willfulness must be based on the objective source by using the rule of law to lock the boundaries of public resources,and combining the assessment of resources with the rule of law to establish the boundaries of power,so that the power list system is compatible with the rule of law;on the other hand,it must be based on subjective sources,not only by conducting belief education,party education,rule of law education,etc.,but also by supervising the main body of power systematically and effectively.Only by governing the power willfulness from both objective sources and objective sources can we fundamentally guard the position of avoiding the power willfulness.
