摘　　要：党的十九大报告首次提出要"加强宪法实施和监督,推进合宪性审查工作",这是全面推进依法治国、依宪治国的重大举措。军事立法的合宪性审查具有重大的时代意义和实践价值。我国军事立法合宪性审查制度尚不完善,要根据宪法、法律的规定,构建符合中国实际的军事立法合宪性审查的路径,有效地保证军事立法活动在合宪性轨道上运行。the 19th CPC national congress report for the first time proposed to"strengthen the implementation and supervision of the constitution and promote the work of constitutional review",which is a major move to comprehensively advance the rule of law and the rule of Consticuton.As an important part of the national legislation system,military legislation must be an important content of constitutional review.Innovatively promoting the constitutional review of China’s military legislation is an inevitable requirement for safeguarding the constitutional authority and enhancing the level of rule of law in the construction of national defense and the armed forces.At present,there are many problems that need to be solved from theory to practice.We should actively explore ways to promote the constitutional review of military legislation in China,properly remove doubts about the legitimacy and legality of military legislation,and more effectively ensure that military legislative activities run on the constitutional track.
