摘　　要：近来,高价值专利备受理论界和实务届的高度关注。目前,为高价值专利的判定设立的标准普遍很高,这种过高的标准可能使得高价值专利判定本身失去意义。实际上,高价值专利判定的首要条件在于良好的市场交换价值,同时辅之以一定的技术先进性和一定的权利即可。另外,需要在我国构建高价值专利培育的生态系统。这主要包括出台高价值专利培育政策体系、改革现行的专利资助(奖励)政策、实施"高价值专利培育工程"、营造高价值专利培育的良好环境等措施。Recently,high value patents have attracted much attention from the theoretical and practical sectors.At present,the standards established for judging high value patents are generally high,and such excessively high standards may make high value patent determination itself meaningless.In fact,the primary condition for the determination of high value patents lies in the good market exchange value,and to supplement certain technological advancement and rights.So,an ecological system for high value patents should be established in China,including issue the policy for high value patent cultivation,reform the prior patent grant(incentive)policy,and implement the"high value patent cultivation project",in order to create a good environment for the cultivation of high value patents.
