温州海域使用权抵押融资的实践与探索

摘  要:海域使用权作为一种用益物权,具有抵押权利,在实践中逐步得到开展应用。源于温州市自然资源丰富,海洋经济贡献突出,又有海域使用权抵押配套法律法规出台为其提供法律支撑,而且温州海域抵押融资需求旺盛,使得温州推进海域使用权抵押融资极具可行性,但由于海洋经济不确定性因素多,风险大,导致金融机构支持动力不足,而且温州海域使用权价值评估滞后,评估结果得不到认可,海域使用权市场发育程度低,导致抵押物无法流转出让,为此建议温州市创新海域金融服务产品,全力支持海域金融发展,培育和发展海域使用权评估体系,推进海域使用权市场化程度,进而大力发展并创新温州海域使用权抵押融资。It is very feasible for Wenzhou to promote mortgage financing of the right since Wenzhou has abundant natural resourceswithoutstanding contribution of marine economy,there are relevant laws and regulations for providing legal support for the mortgage of the right,and since the city has strong demand for mortgage financing.However,there are many uncertainties and large risks in a marine economy;as a result,financial institutions'motive force for supportingit isinsufficient.The evaluation of the value of the right in Wenzhoulags behind and the evaluation results are not recognized.Moreover,the development of the market of the right is at a lower degree,which leads to the non-transferability of collateral.Therefore,it is suggested that Wenzhou innovate the financial service products,fully support the development of sea areafinancing,cultivate and develop the evaluation system of the right,promote the degree of marketization of the right,and then vigorously develop and innovate mortgage financing of the right in Wenzhou.
