区块链视角下音乐版权保护路径变革研究

摘　　要：互联网技术弱化了音乐产业"守门人"的控制权,作品的创作、传播和使用均呈现"去中心化"趋势。针对音乐版权长期存在的权利归属不明、收益分配不均和维权追责不力等现实瓶颈,区块链以去中心化的共享总账,实现了音乐版权的权属自证和运营自治,将原本由中心式机构行使的权利重新赋予创作者,大幅降低了音乐版权流转过程的搜寻、协商以及监督成本。从域外区块链+音乐版权的运营实践来看,各国在智能合约、确权登记、授权交易和侵权追责等方面进行了诸多探索。在此基础上,我国音乐产业可以充分借鉴区块链技术的解决方案,以私有链的形式控制系统节点质量,实现第三方机构的有效监管。The internet technology weakens the control of the gatekeepers in music industry.The creation,dissemination and use of works present a decentralized tendency.In order to solve the long-standing bottleneck of music copyrights,such as unclear rights,uneven distribution of earnings,and ineffective protection of rights.The blockchain technology realizes the self-evidence of ownership and the autonomy of operation by distributed ledger,endowing creators the rights originally exercised by central institutions,thus diminishing the cost of search,negotia-tion and supervision to a large extent in the process of the transfer of works.From the perspective of the operation practice of worldwide blockchain+music copyright,countries have carried out many explorations in smart contracts,confirmation of rights registration,authorization transactions and investigation and affixing of infringement liability.On this basis,Chinese music industry can fully learn from the solutions of blockchain technology,control the system node quality in the form of private chain,and realize the supervision of third-party institutions.
