摘　　要：监狱的本质是统治工具,监狱行刑的自然属性是暴力,监狱的本源目的是惩罚,监狱的终结目标是维护国家治理秩序(统治秩序)。没有暴力和惩罚的监狱不是监狱。(1)实现监狱的本质职能是现代监狱应当坚持的行刑底线。需要准确界定现代监狱的本质属性特征,科学选择适宜的监狱行刑法律样式,以解决当下监狱建设标准混乱、罪犯监管与教育改造缺乏针对性、警力资源和安防资源配置混乱等难题。从监狱顶层设计开始,改革监狱管理体制机制,完善监狱行刑立法,健全法律规则结构,理顺法律责任关系。实施监狱分等,推进罪犯分类和警察资格准入。确立行刑标准体系,改善监狱行刑环境,实施精准执法,精益改造,实现现代监狱的社会角色职能。The essence and natural attribute of prison is a governing tool and violence.The original purpose of the prison is to punish and the ultimate goal of it is to maintain the order(ruling order)of state governance.A prison without violence and punishment is not a real prison.Achieving the essential function of the prison is the bottom line of execution that modern prisons should adhere to.Therefore,it is necessary to accurately define the essential attributes of modern prisons,and scientifically select appropriate prison execution patterns to solve the problems in terms of construction standards confusion,lack of targeted supervision and education reform,police resources and security resource allocation confusion.Starting from the top design of the prison,it should reform the prison management system,improve the legislation of prison execution and the structure of legal rules,and rationalize the relationship of legal responsibility,as well as implement prison grading to promote criminal classification and police qualifications,establish a system of execution standards,improve the prison execution environment,implement precise law enforcement,to finally realize the social role of modern prisons.
