监察机关取证录音录像的价值、功能与过程规制

摘　　要：《监察法》要求调查人员在进行取证时应当对"全过程"录音录像,这与《刑事诉讼法》相关规定相比适用范围更广,要求更严格。这不仅确保了调查人员问询的客观公正性,而且凸显了被调查人员的合法性权利。如若被调查人对证据的合法性提出异议,录音录像可以对案件审理情景进行真实还原。同时,录音录像也是实施非法证据排除规则的需要。监察机关录音录像的功能定位主要体现在收集言词证据、实物证据等两个层面。讯问、询问和谈话构成收集言词证据的基本措施,而搜查、查封和扣押属于收集实物证据的主要方法。同时,录音录像的保管、移送、调取以及播放都必须贯穿"全过程"的法制流程。因此,科学且合理地运用录音录像,在一定程度上规制且规范了监察机关调查取证行为。The“Supervision Law”clearly stipulates that major evidence collections such as interrogation,search and seizure should be conducted with audio and video recording.The scope of application of the relevant provisions of the“Supervision Law”is wider and the requirements are stricter than that contained in the“Criminal Procedure Law”.The video recording of the entire process of work of collecting evidence is conducive to the protection of investigators and the accused persons.It is also necessary for the implementation of the rules for the exclusion of illegal evidence.If the recording is interrupted due to objective reasons,the evidence collecting work should be suspended until the recording is resumed.If the accused disputes the legality of the evidence,the audio and video recording can be used to prove what happened at that time.When reviewing the legality of the evidence,the court and the procuratorate may,if necessary,request the recording of the evidence obtained by the supervisory authority.Video recordings may involve state secrets or other circumstances that are not suitable for public disclosure.The court shall decide whether to play and how to play it.The recording may be played in a small area for the relevant participants,and the relevant personnel may sign a confidentiality agreement.
