摘 要:我国民间融资监管双方的行为策略都存在非理性问题。主观博弈理论认为,法律可通过影响预期利益、行为组合和合作观念来促进博弈参与方的行为理性。而我国当前的民间融资监管法律存在不能有效整合双方预期利益、优化双方行为组合和增强双方合作观念等问题。为促进民间融资监管双方的行为理性,需要从协调双方利益关系、合理区分双方行为的市场活动范围、均衡双方的博弈实力等方面完善相关法律制度。Both private financing regulator and supervisor's behaviors can be irrational. From the perspectiveof subjective game theory, irrational behavior can be rectified through expected interests of influence,behavior combination and cooperation concept by law. There are some problems in current private financinglaw in governance such as inefficient integrating of expected interests for both parties, how to betterbehavior combination and how to strengthen cooperation etc. We should improve relevant legal system fromsuch aspects as coordinating the interests, reasonably distinguishing the scope of market activities andbalancing the game strength for both parties.
