摘　　要：一段时期以来,我国的法治评估理论与实践中存在着明显的规范主义立场,从而导致既有的法治评估体系对区域经济社会及法治发展不平衡之现状考量不足,同时基于法治发展区域化差异的精细化构建程度不够。这表明,规范主义立场的法治评估已经无法满足新时代背景下我国法治建设的实践需求,亟须从理论与实践两个维度实现区域化转向。这种区域化转向既是必要的,也是可行的,具有深厚的理论基础与鲜活的实践资源。具体而言,新时代法治评估理论的区域化转向,要求立论着眼点从"一致性"转向"差异性",讨论场域从"理论象牙塔"深入"实践机理",研究立场从"普世价值"回归"中国道路"。新时代法治评估实践的区域化路径,要求明确区域法治评估的客观条件,找准区域法治评估的层次定位,厘清区域法治评估的制度空间,优化区域法治评估的体系安排。法治评估的区域化转向是中国特色法治评估体系构建的必由之路,同时有待于结合具体实践场景进一步拓展深化提升。The appraisal of rule of law in China has long been dominated by the normative doctrine in both theory and practice,making the current appraisal system fail to pay adequate attention to the imbalance between the socio-economic development and the development of rule of law in a certain region.At the same time,the divergence in the development of rule of law between different regions has also failed to be precisely identified.All this indicates that the normativism-based appraisal cannot meet the practical requirements for China's development of rule of law in the new era.Therefore,a turn for focusing on regional rule of law should be in order in both theory and practice.This change is not only necessary but also feasible because we can get access to rich and profound theoretical and practical resources in this regard.To be specific,the turn for reginal issues in the theorization on measuring rule of law involves a series of shifts:e.g.from unity to difference in research focus;from theory for theory's sake to the theoretical accommodation of practical issues in scope;from universal values back to Chinese road in standpoint.The practical approach to measuring regional rule of law in the new era lies in clearly defining the objective conditions needed,setting a correct target,specifying the institutional space for such appraisal practices,and improving the relevant institutions.The turn for regional issues is the only path to developing the appraisal system for rule of law with Chinese characteristics,which will be further improved when it is applied in different contexts.
