中俄现行瑕疵婚姻制度比较研究

摘　　要：中俄现行瑕疵婚姻制度各具特色。中国瑕疵婚姻制度包括无效婚姻、可撤销婚姻、婚姻不成立、撤销结婚登记等;俄罗斯瑕疵婚姻制度包括无效婚姻、婚姻不成立。在无效事由上,中国更强调客观条件,俄罗斯更强调主观条件。我国应建立以无效婚姻、可撤销婚姻、婚姻不成立为原则,以撤销结婚登记为例外的瑕疵婚姻制度。The flawed marriage legal system,currently implemented in China and Russia,have similarities and differences,with respective characteristic.The structure of current flawed marriage legal system in China,in civil aspect,includes void marriage,voidable marriage and unsustainable marriage.That in administrative aspect is cancellation of marriage registration.In Russia,the current flawed marriage legal system involves void marriage and unsustainable marriage.On the cause of the void marriage,subjective conditions are emphasized more in Russia while objective conditions are stressed more in China.Our Country should establish a complete flawed marriage legal system,taking void marriage,voidable marriage and unsustainable marriage as the principle and cancellation of marriage registration as the exception,which respectively correspond to violating objective conditions of marriage,violating subjective conditions of marriage(intimidated),sham marriage as well as lack of marriage form requirements and flawed marriage registration procedures.
