摘　　要：现代社会关涉个人信息的行为日趋多样。互联网技术丰富了个人信息获取与利用的渠道,也使干预行政背景下有限的规制手段略显乏力。行政给付作为一种以授益性为主要特征的行政行为,在回应公众申请、给予物质扶助的同时,亦将提供社会、经济、文化性服务作为新时期关键主题。厘清个人信息保护中的行政给付问题,需要打破我国传统行政法理论过度强调财产性给付的观念,拓宽给付的形式内涵,为公民权利保障提供更多合理途径。与此同时,也要注意把握行政给付的限度,防止泛化风险,并促进行政给付与其他行政行为的衔接,全面实现个人信息保护体系的法治化与现代化。In modern society,the types of behavior concerning personal information are increasingly diversified.Under the context of the change of state functions,the way in which the administrative agencies provide protection is no longer confined to traditional imperative or mandatory actions.The development of Internet technology has enriched the ways in which personal information is obtained and used,meanwhile it has made the limited regulatory means under the administrative order background slightly weak.As a kind of administrative behavior characterized by granting benefits,administrative supply will also provide social,economic,and cultural services as key topics in the new era,with responding to public applications and granting material assistance.To clarify the issue of administrative supply in the protection of personal information,it is necessary to break the traditional view of administrative law that emphasizes the payment of property,to broaden the connotation of payment,and to include the construction of a new digital platform.At the same time,it is also important to grasp the limits of administrative supply,prevent them from generalizing risks,and to promote the convergence between administrative supplies and other administrative actions,by which to fully realize the legalization and modernization of the personal information protection system.
