我国体育腐败犯罪的含义、原因及刑事对策

摘　　要：体育腐败犯罪是相关行为人,通过非法手段谋取不正当利益,给体育公共利益造成了损害的行为。我国体育腐败犯罪形成的原因包括体育管理体制存在缺陷、体育产权界定不清、体育运作机制不健康、体育立法缺失等客观原因,以及拜金主义盛行、职业道德缺失、投机心理作祟以及分配不公导致行为人心理扭曲等主观原因。为了打击体育腐败犯罪,应当对刑法罪名、刑罚及非刑罚措施、追诉时效、职业禁止制度等进行立法完善。Sports corruption crimes refer to the behaviors related actors conduct by seeking illegitimate interests through illegal means and thus cause damage to the public interest of sports.The objective reasons for the formation of sports corruption crimes in China include the flaws in the sports management system,the unclear definition of sports property rights,the unhealthy sports operation mechanism,the lack of sports legislation,and the subjective reasons include prevalence of money worship,lack of professional ethics,speculation,and psychological distortion in unfair income distribution.In order to combat sports corruption crimes,the criminal charges,penalties and non penalties,timeliness of prosecution,and occupational prohibition systems should be improved.
